Terms of Service

These Terms govern your access to and use of viralari (the "Service"), operated by Viralari ("we", "us", "our"). By creating an account or using the Service you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, whichever is greater. You agree to provide accurate information when registering and to keep your account credentials secure.

2. The Service

viralari analyses public Instagram and TikTok content from accounts you connect to surface patterns and generate hooks. We use the public profile data exposed by these platforms via authorized data providers. You confirm you have the right to connect any account you submit. We do not access private profiles, do not require OAuth permissions, and do not modify, post, or delete content on your behalf.

3. Subscription, billing, trial

Paid plans are billed monthly via our payment processor. New subscriptions start with a 7-day free trial that requires a valid payment method. If you do not cancel before the trial ends, you authorize us to charge the listed price for your selected plan. You can cancel from your account settings at any time. Cancellation takes effect at the end of the current billing period and we do not pro-rate partial months unless required by law.

4. Refunds

You may request a refund within 14 days of any charge by emailing [email protected]. Reasonable requests are granted. Refunds are at our sole discretion outside of statutory rights in your jurisdiction.

5. Acceptable use

You agree not to: (a) reverse engineer the Service or attempt to extract source data we did not intentionally expose, (b) use the Service to harass, defame, or impersonate any person, (c) submit accounts you do not have rights to analyse, (d) resell, white-label, or redistribute the Service or its outputs as a service to third parties without a written agreement, (e) use the Service to generate content that violates Instagram or TikTok Community Guidelines or applicable law.

6. Generated content

Hooks, narratives, and analyses produced by the Service are provided to you for use in your content. You are responsible for reviewing all generated material before publishing. We make no warranty that generated content is accurate, original, or fit for any particular purpose. You retain ownership of content you create using outputs of the Service, subject to applicable law.

7. Intellectual property

We retain all rights in and to the Service, including the underlying software, models, prompts, and brand assets. The data you submit, and the public posts we analyse on your behalf, remain yours and are subject to the original platform's terms.

8. Privacy

Our handling of personal data is described in our Privacy Policy.

9. Termination

You may terminate your account at any time. We may suspend or terminate your access for material breach of these Terms with reasonable notice, except in cases of fraud, abuse, or risk to other users where we may act immediately.

10. Disclaimers

The Service is provided "as is" without warranty of any kind. We do not guarantee that pattern detection or hook generation will improve your reach, engagement, or revenue. Outcomes depend on factors outside our control, including platform algorithms, your audience, and your execution.

11. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of these Terms or the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, consequential, or incidental damages.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of United States, without regard to conflict-of-law principles.
